Terms & Conditions

Article 1: Online sales

Chamo BV operates the Website for the sale of its products to customers around the world. The present terms and conditions govern the sale of the products through the Website. The Company, hereafter also referred to as “we” or “us” is established in Geraardsbergen and has company number BE0875.816.760. It can be reached by telephone at +32 54 240 330 and by e-mail at bureau@chamo.be. The buyer is any person who purchases or orders goods or services through the Website www.babylonia.eu and is hereinafter referred to as the “Buyer” or as “you”. By purchasing or ordering goods and services through the Website, you irrevocably accept these Terms and Conditions as they exist at the time of ordering and the application of all other terms and conditions is excluded.

Article 2: Price

The prices of our goods and services are listed on the Website in euros and include VAT and other mandatory additional charges. The cost of delivery is stated separately according to the choices made in this regard. Prices are payable in Euros regardless of the place of delivery or residence of the Buyer. The Company is not liable if customs duties or other local fees or taxes are charged for the delivery of goods and services outside the European Union. Any such duties or taxes shall be borne by you, the Buyer, and you shall also be required to make representations to the competent authorities of the country of delivery as appropriate. The Company reserves the right to adjust its prices at any time without prior notice. Goods and services are invoiced based on the price in effect at the time the order is registered, subject to availability and subject to administrative errors. The goods remain the property of the Company until full payment of the price. Notwithstanding this retention of title, the risk of loss or damage passes to the Buyer from delivery of the goods. Any promotions are valid until the date indicated or, in any case, for a maximum of one month after the announcement. They are not cumulative among themselves. Discount coupons cannot be exchanged for cash value and are neither fully nor partially refundable.

Article 3: Establishment of the purchase-sale

The purchase-sale is concluded after you have selected the goods and services on the Website, you have confirmed the purchase after reviewing the goods and services ordered and the price, the order has been received by us and we have confirmed the order to you. The Company reserves the right to cancel any order from a customer with whom there is a dispute regarding the payment of another order. The Company also reserves the right, for the safety and security of the customer, to request additional information and, failing this, to refuse to execute the order.

Article 4: Availability

Our offers are valid until exhaustion of stock or subject to availability from the supplier or manufacturer. In case of unavailability after your order has been placed, we will inform you as soon as possible without being obliged to pay any compensation. We exclude any liability in this regard.

Article 5: Delivery

Upon acceptance of your order and payment, the goods or services will be delivered to the delivery address you entered during the ordering process. Unless otherwise provided, delivery will be made within 30 days of ordering. After the expiration of this period, you have the right to demand the cancellation and refund of your purchase. Otherwise, the Company does not bear any responsibility due to late delivery, nor in case the delivery cannot take place due to wrong or incomplete information, provided by the buyer when ordering.

Article 6: Right of withdrawal

If the Buyer is a consumer who purchases goods or services remotely, he has the right to notify the Seller that he renounces the purchase, without payment of a penalty and without giving a reason, within 14 calendar days from the day following the delivery of the good or the conclusion of the service contract. Refunds will be carried out within a period of 30 days from receipt of your request for withdrawal. Refunds will be made by transfer to your bank account or by crediting your credit card. The consumer does not have the right to withdraw from the purchase in the cases stipulated by law and among others when the goods have been manufactured according to the consumer’s specifications or when the performance of the service contract has begun before the end of the withdrawal period.

Article 7: Payment

The Buyer may pay for his order by debit or credit card, by Paypal or iDeal or by bank transfer to our bank account, as indicated on the Website. The price must be paid in full before delivery. In case of late payment, a late payment interest in the amount of 6% per year is due, by right and without prior notice, as well as a lump sum compensation for the Seller’s administrative costs in the amount of 10% of the amount due with a minimum of 100 euros.

Article 8: Gift certificates

The Company’s electronic and paper gift certificates can be used on the Website www.babylonia.eu. They are valid for one year from the date of issuance and may be renewed for another year through an administrative fee. To use the vouchers, on the “Payment” page select option “Other payment options”, then “Gift Voucher”. Enter your code in the box provided. If the amount of your order is higher than the amount of your gift certificate, you must pay the difference. If the amount of your order is less than the amount of your gift certificate, you will keep this balance in the form of a credit. You can track the progress of your credit through the “my account” section.

Article 9: Intellectual Property

All texts, comments, magazines, illustrations and images displayed on the Website www.babylonia.eu are protected by copyright and neighbouring rights, as well as by any intellectual property right throughout the world. Any partial or total reproduction of the website or of the catalogue of the Company is strictly prohibited.

Article 10: Responsibility

The Company undertakes to provide some goods and services that comply with the applicable legislation of the European Union and Belgium. The Company cannot be held liable in case of non-compliance with the legislation of a country outside the European Union where the products are to be delivered. For goods sold to consumers, the legal warranty of two years applies. Any non-conformity regarding the sale to the consumer must be reported within two months of its determination. Any complaint regarding visible damage to delivered goods as well as damage caused during transport and delivery must be formulated in writing on the accompanying documents at the time of delivery or must be reported by email within 24 hours of delivery. The same applies to non-conforming or incomplete deliveries. Article 11: Processing of personal data

When ordering as part of your purchase online, at www.babylonia.eu, you accept that the Company uses your personal data in accordance with the applicable law of December 8, 1992 on the protection of privacy with respect to the processing of personal data. The Company uses your personal data for the execution of the agreement and to keep you further informed about our goods and services, including through direct marketing. You have the right to access your data at any time and to have them changed if they are incorrect.

Article 12: Autonomy of the provisions

The nullity, invalidity or unenforceability, in whole or in part, of any provision of these Terms and Conditions, or of any term or part thereof, shall not invalidate, invalidate or unenforce the remaining provisions, terms, and parts thereof, nor affect the validity and enforceability of the Terms and Conditions as a whole.

Article 13: Applicable law and competent courts

These General Conditions of Contract are subject to Belgian law. In case of dispute, only the courts of Brussels have jurisdiction, without prejudice to the consumer’s right to bring an action before the courts in his jurisdiction.
